Terms of Service

These Terms of Service ("Terms") are a contract between you and TikiMiki ("TikiMiki", "we", "us") and govern your use of the TikiMiki website and video-creation service (the "Service"). By using the Service or placing an order, you agree to these Terms.

The Service

TikiMiki lets you create short promotional videos by choosing a template, adding your text and media, and ordering a rendered video for a one-time fee shown at checkout. Optional features include AI-assisted script suggestions and AI-generated voice-over from text you provide.

Eligibility

You must be at least 18 years old (or the age of majority where you live) to use the Service and place an order. By using the Service you confirm that you meet this requirement and that you are using the Service for lawful, business or personal promotional purposes.

Orders & payment

• Prices are shown before you pay and are charged as a one-time fee per video via Stripe.
• Your video is rendered and emailed to you after successful payment.
• Applicable taxes may be added at checkout.
• Refunds are governed by our Refund Policy.

Because each video is personalized, you expressly request that creation and digital delivery begin immediately after payment. Where EU/UK withdrawal rules apply, you acknowledge that the withdrawal right for the digital content may end once performance and delivery are complete. This does not limit non-waivable rights for defective or undelivered content.

Your content & responsibilities

By uploading text, photos, logos, or video ("Your Content"), you represent that:

• You own Your Content or have all rights and permissions needed to use it, including rights to any people, logos, trademarks, or music shown in it.
• If a minor appears in Your Content, you have permission from that minor's parent or legal guardian and your use does not exploit or endanger the minor.
• Your Content does not infringe anyone's rights and is not unlawful, defamatory, hateful, or sexually explicit, and does not depict minors inappropriately.
• You will not use the Service to create misleading, fraudulent, or deceptive material, or to impersonate others.
• You will not upload protected health information (PHI), patient-identifiable medical material, or other health information that requires a HIPAA business-associate agreement. The Service is not offered as a HIPAA-compliant service and TikiMiki does not enter into BAAs.
• You will not upload identity documents, financial account credentials, or other sensitive personal data that is not necessary to create the video.
• Any testimonial, review, before/after comparison, or health, earnings, or performance claim is genuine, used with permission, substantiated, and accompanied by every disclosure required by applicable advertising law.

You retain ownership of Your Content. You grant us a limited license to host, process, and render Your Content solely to provide the Service to you. You are responsible for Your Content and for how you use the videos you create.

License to your finished video

Once paid, you may use your rendered video for your own personal or business promotional purposes. Stock assets, fonts, music, and templates that we provide remain ours or our licensors' and are licensed to you only as part of the finished video; you may not extract or resell them separately.

AI features

Some features use artificial intelligence: the editor offers built-in script suggestions to help you write your copy, and voice-over audio is generated from your text with a third-party provider (ElevenLabs). Text you submit may also be screened by an automated moderation provider (OpenAI) for safety and legal compliance. When you use these features you also agree to those providers' usage policies. In particular, you agree that you will not:

• Generate a voice-over that imitates the voice of, or is presented as spoken by, a real identifiable person without their permission;
• Use AI script or voice output to impersonate a real person or organization, or to create false, misleading, or deceptive statements presented as fact;
• Generate content that is unlawful, hateful, harassing, sexually explicit, or otherwise prohibited by these Terms.

AI-generated suggestions and audio are provided "as is." You are responsible for reviewing them and for the final content of any video you order and publish, and for adding any AI-disclosure your jurisdiction or platform requires.

Industry & professional content

Templates for regulated fields (including real estate, legal, medical, and financial) are tools only. You are solely responsible for ensuring your video complies with the advertising, licensing, disclosure, and fair-housing rules that apply to your profession and location. We do not review videos for regulatory compliance and provide no professional, legal, medical, or financial advice.

Copyright & DMCA

We respect intellectual-property rights and expect users to do the same. If you believe content created or hosted through the Service infringes your copyright, send a notice to our designated agent with: your contact details; identification of the copyrighted work; identification of the allegedly infringing material and where to find it; a statement of good-faith belief that the use is unauthorized; a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorized to act; and your signature.

Reporting & content removal

To report content you believe violates these Terms or the law, email abuse@tikimiki.video. We may remove content and suspend or terminate accounts at our discretion. We do not tolerate child sexual abuse material (CSAM) or other illegal content; where we become aware of it we will remove it and report it to the appropriate authorities, including the National Center for Missing & Exploited Children (NCMEC), as required by law.

Acceptable use

You agree not to misuse the Service, including by attempting to bypass payment, overload or probe our systems, scrape or abuse our APIs, or upload malicious files. We may suspend or terminate access for violations of these Terms.

Service availability

The Service is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted availability and may modify or discontinue features. Remember that finished videos and uploads are automatically deleted after about 10 days — please download your video promptly.

Disclaimers & limitation of liability

To the maximum extent permitted by law, we disclaim all implied warranties. Our total liability for any claim relating to the Service is limited to the amount you paid for the order giving rise to the claim. We are not liable for indirect, incidental, or consequential damages.

Indemnification

You agree to indemnify and hold us harmless from claims arising out of Your Content or your misuse of the Service or violation of these Terms.

Governing law

These Terms are governed by the laws of the State of North Carolina, USA, without regard to its conflict-of-laws rules.

Changes

We may update these Terms from time to time. Continued use after changes means you accept the updated Terms.
